Following a precedent-setting ruling by the Konstanz Regional Court, an online poker player successfully recovered ?16,600 in lost stakes due to the operators lack of a valid German license. The court declared all contracts concluded via TSG Interactive Gaming Europe Ltd and pokerstars.eu null and void. This decision aligns with Advocate General Emilious opinion at the CJEU, highlighting reinforced chances of reimbursement for German players engaged in unlicensed online gambling.

Court Rules PokerStars EU Contracts Void Without German License

In proceedings at the Konstanz Regional Court, a CLLB Rechtsanwälte client played online casino games, poker, and sports bets via pokerstars.eu between July 2015 and October 2022, losing about ?16,600 in total. On April 21, 2026, the court found the contracts invalid because TSG Interactive Gaming Europe Ltd. lacked a German licence. It ordered the operator to refund all the clients stakes previously risked during that period and losses fully.

German court rules Malta license void without German authorization

TSG Interactive Gaming Europe Ltd operates multiple gambling platforms licensed in Malta but without German authorization under the state treaty on gambling. The Regional Court of Konstanz clarified that this Maltese license cannot validate operations in Germany. Two days later, Advocate General Emiliou to the EU Court declared Maltas Bill 55 incompatible with EU law. Should the Court follow his advice, Germanys rulings would require recognition and enforcement in Malta.

German licensing requirement remains mandatory for online gambling providers

Until July 1, 2021, online casino games, poker, and sports betting were strictly prohibited in Germany; recent amendments now permit them via operators holding a German license. A regional court clarified that even after gambling markets partial opening, no exemptions apply to unlicensed providers. The judgment followed the European Court of Justices April 16, 2026 ruling, which confirmed national prohibition does not infringe upon EU freedom to provide digital services.

Court Declares Player Ignorance Cannot Block Illegal Gambling Compensation

The claimant asserted he was unaware of Germanys licensing requirement. The court held that ignorance did not bar his entitlement to restitution nor diminish his claim. Crucially, the agreements were deemed unlawful for lack of proper authorization. Participation in illegal online gambling did not prevent him seeking damages or recovery, since invalid contracts explicitly entitled him to full repayment of all lost stakes under applicable law pursuant to statutory provisions.

Konstanz decision lets Germans reclaim banned online gambling losses

Attorney Thomas Sittner of CLLB Rechtsanwälte highlights the significance of the Konstanz Regional Court ruling and subsequent decisions for German players seeking reimbursement. He notes that losses incurred through unauthorized online gambling activities can be recovered. The clarification of licensing requirements under German law empowers poker enthusiasts, enabling them to pursue claims against domestic operators and service providers based in Malta. These decisions provide clear pathways to recover their stakes.

Overall, the Konstanz Regional Courts decision confirms that online gambling agreements concluded without a German license are invalid under domestic law. As a result, affected players can reclaim the full amounts they lost, regardless of the duration or nature of their wagers. This ruling establishes a clear precedent for securing reimbursement, while also encouraging poker enthusiasts to participate in future events on platforms that fully comply with Germanys regulatory requirements.
